Arushi Talwar (Aarushi Talwar): Ghaziabad special court closes case

Arushi Talwar, 14, was stabbed dead in her house in Sector 25, Noida. Arushi Talwar was in her bedroom. Arushi Talwar could have died from deep stab wounds.

Arushi Talwar was found dead by her father, Rajesh Talwar. Arushi Talwar was discovered dead only in the morning of Friday, May 16, 2008, as her father Rajesh Talwar went to awaken her. The Talwar family’s domestic man-maid, Hemraj, was missing. Police suspected him immediately. There was a reward of Rs. 20,000 for information on him. His full name was Yam Prasad Banjade alias Hemraj.

One day passed before Hemraj was found. Senior police officer K.K. Gautam, a neighbor, visited the Talwar family to offer condolences. His cop instincts led him to investigate the roof top terrace.

The door was locked from the inside of the house so he broke the lock. Imagine his horror when he saw the dead body of Hemraj. There was a long trail of blood. There were signs that the body was dragged by one or more people. There were no blood stains on the staircase. Police assumed Hemraj was killed on the terrace.

K.K. Gautam said that he saw some clues in Arushi Talwar’s bedroom. However, he did not reveal the full extent of what he understood he saw. Police investigations were on-going and details could not be revealed for fear of hampering the investigation.

Both Arushi Talwar and Hemraj had slit throats.

SP (City) Mahesh Kumar Mishra has been transferred after the foul up in the investigation.

Hemraj. Yam Prasad Banjade alias Hemraj is from Nepal.

Dr. Rajesh Talwar works at Fortis Hospital in Noida. Arushi Talwar’s mother, Dr. Nupur Talwar, runs a dental clinic.

Arushi Talwar was a Class IX student of Delhi Public School in Noida.

Arushi Talwar’s body was prepared for her last rites. Many pall bearers carried her body respectfully out of the house.

Hemraj’s son-in-law, Jeevan Sharma, was a suspect. The house was not broken into. The post mortems had determined that Arushi Talwar and Hemraj were murdered by the same weapon. Police said that the killer was an expert and had a steady hand on the knife.

A former domestic helper, Vishnu, was a prime suspect too. Vishnu used to offer Hemraj as a replacement helper when he took annual leave of 2 months each year. Eight months ago, when Hemraj was hired to replace Vishnu, Hemraj became a permanent employee of the Talwars. When Vishnu returned, he found that he was out of a job. Vishnu could have a motive for the double killing to exact revenge. Police were still investigating.

Vishnu’s full name is Vishnu Sharma alias Vishnu Thapa.

On the same morning of the murders, another part time maid, Bharti, arrived at the house to work. Bharti found the gate locked on the outside of the house. Madam Dr. Niranjan threw down the keys from her balconey and the maid opened the gate to enter the compound.

So far, police have interviewed all the domestic maids, past and present. They had also questioned both parents’ staff at their offices.

A ‘mystery scrapper’ visited Arushi Talwar’s Orkut profile regularly. This internet identity reminded her about murder victims over the internet sites.

The forensic science police revealed that the autopsy of Arushi Talwar found semi-digested food in her stomach. It indicated that she had a late dinner. It was estimated that her last meal was at 11 pm.

The autopsy on Hemraj told that his stomach had liquid contents. The fluid was identified as alcohol. Police made enquiries and established that he was a frequent drinker of liquor.

Police were working on the theory that Vishnu retuned to plead to get his old job back. The Talwars refused to hire him since they already had Hemraj to help them. Vishnu killed Hemraj. Vishnu could have realized that Arushi was in the house and she knew or saw him commit a crime. He could have killed Arushi to silence her. Police said they were searching for accomplices.

Police have reconstructed the case on the eve or night of the murder. The parents of Aarushi Talwar returned home at 10 pm. The parents and Aarushi Talwar sat down to have dinner at 10:30 pm or approximately that time. A courier arrived with a package. It contained a video camera. It was a special gift to Aarushi Talwar from her parents to celebrate a surprise gift. Aarushi Talwar had expressed her delight upon receipt of her gift. At 11:15, Dr. Niranjan went to Aarushi Talwar’s room to seek help to get an internet connection. That was the last time the mother saw her daughter alive.

The next morning, at around 6 am, when Aarushi Talwar’s father went to his daughter’s bedroom, she was already found dead. When the Talwars failed to locate Hemraj, they dialed his cell phone. They said the line was cut. Police said that they have verified the existence of this call. They identified the area where the call was made but what about the area where the call was transmitted and received at the point it was cut? The suspected killer had removed Hemraj’s phone while he had died on the terrace roof top of the house.

Corrections:

At a later date and time, Dr. Nupur Talwar gave an interview to the media. She said that the courier came on Thur. May 15 in the morning, around 10 am. The gift was a digital camera and not a video camera.

The Talwars’ garage outside the house was raided and sealed in the afternoon. Some journalists claimed a foul smell was emitted from the garage. The garage housed the couple’s clinic previously in 2005 – 2006.

Dr. Niranjan and Dr. Rajesh Talwar have refused to give any statements to the media. Dr. Rajesh Talwar said that his comments could harm him.

Hemraj’s cell phone call records.

Call records of Hemraj /Banjade indicated that the last call was made to the phone at 6 am, Friday. The number which originated the call (0120-4316388) was traced to a PCO booth in Nithari village. The lady owner of the shop was also questioned on Wednesday, May 21, 2008.

The owner could not identify the person who made the call. It lasted 400 seconds. This indicated that someone had received a call on Banjade’s phone after he was killed.

Arushi Talwar’s father or (both parents), claimed that he made a call to Hemraj’s cell phone after they could not locate him in the house. Telecommunication officials said that no calls were made from the Talwar house to Hemraj’s phone on that fateful morning.

A newspaper quoted the chief investigating officer boasting that the police have sufficient leads to break this mystery in the next 24 hours.

Police said that on Thusday night at 9 – 9:30 p.m., Arushi Talwar spoke to her friend Anmol from her mobile phone. The phone companies have released the details of the calls. The cell phones of both Arushi and Hemraj were still missing.

People should report if they have received calls from these two numbers as the cell phones could be sold to unsuspecting individuals.

There were conflicting reports on the post mortem results of the victims. One media report said there was no alcohol found in the stomach of Hemraj. The common agreement on the post mortem on Aarushi was that she had eaten a few hours before getting murdered as her stomach contained partially digested food. So, she was killed between Thursday May 15, 11:15 pm and 6 am, Friday, May 16. The common ground that was shared in the press was the police autopsy that declared Aarushi had no indications of sexual assault.

Both Arushi Talwar and Hemraj had similar wounds on their necks which were probably caused by a surgical scapel. Police know doctors are handy with surgical instruments and incisions.

On Wednesday, it was established that the authorities incharge of the twin murder cases were Senior Superintendent of Police Noida A.S. Ganesh, Special Task Force (STF) and a few others.

Superintendent of Police (City) Mahesh Mishra was transferred out on Sunday afternoon, May 18, 2008. The station house officer of Sector-20 police station of Noida was also transferred out.

The full adddress of the murdered victims was released in the hope that the public can come forward to offer information on L-32 Jal Vayu Vihar home in Sector-25, Noida.

Rajesh Talwar gave a different version in his story. He said he got up to open the gate to a part time domestic maid that had just arrived. The maid, Bharti, said that the Madam Dr. Niranjan had tossed down the keys from the balconey. Bharti opened the gate, not Dr Rajesh Talwar.

Rajesh Talwar and Dr. Niranjan have refused to answer questions, dodged questions, or replied vaguely.

Police examined the cell phone records of Aarushi Talwar and Dr. Rajesh Talwar. Dr. Rajesh Talwar made 197 phone calls to a woman, who has been identified as a lady doctor friend. On Thursday night, Rajesh Talwar made 6 calls to this woman.

Rajesh Talwar’s driver, Umesh, said that Dr. Rajesh Talwar did not go to work on Thursday. Yet, earlier reports said that the parents returned home at 10 pm.

Umesh said that he was instructed by Rajesh to carry Aarushi’s bloodstained mattress to the terrace and leave it there. Umesh carried it with the help of Vikas, the clinic manager.

Arushi Talwar’s friends said that Arushi appeared to be perfect on the superficial level. Arrushi Talwar received text messages from her own friends and she would call them back on her cell phone. Police said that they had spoken to these people.

Aarushi Talwar an a profile at Orkut. She described herself as being friendly. She had discussed the usual teen issues like dating, breaking up, and hanging out.

Noida’s SP (City), Ashok Tripathi said that his police raided Dr. Rajesh Talwar’s makeshift clinic on Tuesday, May 20, 2008. Some news reported that this clinic was un-used and re-converted into a garage. Some reports said this was still a temporary makeshift clinic.

Officers found some things and removed them but refused to disclose what they found.

Aarushi’s father, Rajesh Talwar, has made a statement to the media. He said that he was not involved in the murders.

Police have questioned Sameer Tipnis. He is Arushi’s maternal uncle, who is currently based in Dubai. Police thought that he held some clues that were crucial to the case. An uncle in Dubai …

There was also some disturbing information about the eve of the murder. Arushi Talwar was beaten on that night. Yet she received a camera on the same night. Punishment and incentive went hand in hand in the house.

Noida Senior Superintendent of Police A Satish Ganesh gave a press conference on Thursday, May 22, 2008. He said that it would take another 15 more days for the police to crack the case. He appealed for the media to help the police. He said the police were exploring the motives of crime of passion and honor killing. One person was killed in a fit of anger in a crime of passion. Another person was killed to silence him/her as an honor klling.

The police forensic/ coroner did a visual check on Aarushi’s corpse and said that there was no sexual assault but they did not do the slide test.

(What’s a slide test in police terminology? Can it be assumed that it is a swab of the body fluids to determine the composition of the internal fluids?)

This was revealed by another one of the police officers. He implied that the slide test was an option to discover more information. The body has been cremated. There is no more chance of checking for more information.

Sify News said that Arushi Talwar’s friend, Anmol, was interrogated on Thursday. Phone records showed that they had talked 688 times in the past month; between April 1 and May 15.

Ibn live said that police used a Honda Civic car to transport the Talwars and an uncle to an undisclosed location but gave up after the media started following them. The place was rumored to be Haridwar.

Dr. Rajesh Talwar has been arrested. Police suspect that his daughter, Arushi, knew about her father’s extra-marital affair and she was close to Hemraj and he could have known about it too.

Dr. Nupur Talwar, also a dentist, and Rajesh Talwar’s doctor colleague, Dr. Anita Durrani, may have been detained.

Police wish to bring Dr Rajesh Talwar to the place where he disposed the murder weapon in order to recover it. There could also be a hammer involved.

Mynews reported that Rajesh Talwar has confessed to police about the double murders. The motive was because Arushi Talwar knew about her father’s illicit affair with another woman. Arushi Talwar used to talk to Hemraj about it. Later, Arushi Talwar became intimate with Hemraj.

Police said that Dr Rajesh Talwar used to bring Anita Durrani into his house when his wife was out. The servants knew about this. Hemraj told Aarushi Talwar.

On Thursday night, Rajesh Talwar went into his daughter Aarushi’s room and discovered Hemraj there. Rajesh Talwar supposedly asked Hemraj to go upstairs to the terrace. Rajesh brought along a hammer and surgical knife. Rajesh Talwar hit Hemraj on the head and then slit his throat.

Hemraj was afraid that Dr Rajesh Talwar might kill him becasue he was already scolded by the doctor for talking about his illicit relations.

Arushi Talwar supposedly confronted her father about his relationship with the other woman. She had objected to it.

There were conflicting reports from media. Some press reports wrote that Rajesh Talwar had confessed. Some wrote that he protested his innocence. Rajesh Talwar said that a man called Dinesh Verma framed him for the murders.

Yam Prasad Banjade alias Hemraj’s body was undiscovered when two men (Rajesh Talwar’s workers) brought the mattress up to the terrace because it was hidden. A cooler lid had been placed over the body.

Anita Durrani said that she and Nupur were good friends. Those 197 calls were between her good girlfriend Dr. Nupur and herself. Dr. Nupur could have borrowed her husband Rajesh Talwar’s cell phone to use to talk to her. That was how Dr. Anita Durrani explanied the hundred over calls to her cell phone.

The Durranis and Talwars were good friends for over 13- 14 years. They were like an extended family. On Thursday or Friday, the day of the murder, Anita Durrani said she was in Dehradun.

A police officer had collected evidence from the rooftop terrace of the Talwar house.

KK Gautam, retired police officer, found Hemraj’s boody on the terrace.

Another news report by Sify said that Dr Nupur Talwar supported her husband. She protested that Rajesh Talwar was innocent of the crime he has been accused of. She said that the real killer was still roaming about freely.

Rajesh Talwar and his lawyer have applied for bail.

MSN news said that Abhijeet Chatterjee, Talwar’s lawyer, had said that there was no evidence linking Rajesh Talwar to the crime. No case under section 302 (murder) of Indian Penal Code (IPC) could be made against Rajesh Talwar.

Rajjesh Talwar has serious asthma and was bound to suffer in jail. Abhijeet Chatterjee has applied for bail for his client. The hearing would be on Monday.

Police said they obtained proof. Rajesh Talwar & Nupur Talwar told the priest in Hardwar to record Arushi Talwar’s time of death as 2:30 am, on Friday morning, May 16, 2008.

These parents told police they discovered Aarushi Talwar’s body at 6:30 am Friday morning. Police learnt about the actual hour of Arushi’s death about 3-4 days after Friday. Police placed the death at between 1 am – 2 am. They said they were surprised that the Talwars knew about it before the police did.

Police questioned Rajesh Talwar based on facts obtained from his celle phone line provider. Rajesh denied receiving calls on Thursday, May 15. Police said this raised serious issues regarding his credibility.

Police tapped the phone lines. They claimed that Rajesh Talwar spoke to his lawyer about bail. He anticipated going to jail even before he was arrested. He spoke to his lawyer on getting bail for him.

On Saturday, May 24, it was Arushi Talwar’s birthday.

Phone records on Arushi Talwar’s calls indicated that she received calls/ text messages every night and the latest time was about 1 am. However, on the night she died, her cell phone records indicated she had no phone activity after 9:10 pm. Police speculated on a variety of reasons-

1) Arrushi’s cell phone was switched off.

2) Aarushi’s cell phone battery died.

3) Arushi’s cell phone was removed from her.

Arushi Talwar’s cell phone and Hemraj’s cell phone are missing.

Different media have reported different dates for Arushi Talwar’s birthday. She wrote a message in her school. It was at the window pane where she sat in class. It asked for birthday wishes.

Dr Nupur Talwar visited her husband in prison. Dinesh Talwar, Rajesh’s brother, accompanied Nupur Talwar on this visit. They had proclaimed that Rajesh Talwar was innocent.

Police have applied to a court for permission to use the narco analysis test on Rajesh Talwar. It involves the use of chemicals to lower the resistance and make the person talk.

Police want this list of missing people & items:

1. Vishnu Thapa and Krishna, 2 suspects, are missing. They were present only for the first interviews.

2. Arushi Talwar’s cell phone.

3. Hemraj’s mobile phone.

4. Rajesh Talwar’s clothes worn on Thursday/ Friday; on the day the murders took place.

Police have seized computer hardware of Rajesh Talwar & Arushi Talwar for computer forensic investigation. All deleted data can be recovered via software recovery system.

Similarly, Orkut may cooperate with the police to retrieve all deleted data that pertained to Aarushi Talwar’s communications.

Some evidence did not collaborate with the accusation against Rajesh Talwar. The police said they found 3-4 glasses that were used to drink alcohol. That night, the adults in the house that might have used the receptacles were Rajesh Talwar, Nupur Talwar, Hemraj. Who was the fourth person to have used the glass? Or, could one person use a clean glass each time he/she wanted to consume an alcoholic drink?

Police claimed that they had records or evidence showing that Rajesh Talwar answered Hemraj’s phone at a certain time after his death. Then, the call was cut off.

The Hindu reported that Rajesh Talwar’s brother, Dr. Dinesh Talwar, proclaimed that Rajesh was 100% innocent and that would be proven in the court of law. Dr. Dinesh Talwar had visited his brother in prison.

When police visited Talwar’s house on Wednesday last week, the media was present. Neighbors had gathered around outside.

Hemraj’s uncle, Ram Prasad, said that nobody should accuse Hemraj of immorality. He was dead and unable to defend his honor. Uncle Ram Prasad said that Hemraj was about 46 or 47 years old. He had a son-in-law, Jeeva, (or Jeevan) and a wife and young children. Uncle Ram Prasad said that character assassination of the dead was low. Ram Prasad said that Arushi was a child at 14. To instigate that she was compromising in morality was incredible.

Jeeva said that Hemraj called him at 5:30 on Thursday. He told that his madam (Dr. Nupur Talwar) had instructed hm not to go to the clinic, as per his normal routine, since Arushi was home alone.

Uma Thakur, the social worker, said that Hemraj approached her on May 11, 2008. Hemraj desired to consult her on a matter. He requested for an hour of audience with her. She told him that she was busy at that time of 7:30 pm. Uma Thakur related that Hemraj looked frightened. The press repeated this claim and asociated this with Hemraj reportedly telling a few friends that he feared for his life. It was rumored that he had gossiped about the relationships of Rajesh Talwar and was afraid of repercussions.

Umar Thakur claimed that she had spoken to Hemraj’s son-in-law. She claimed that the younger man told her that Hemraj and Arushi shared a normal relationship and there was nothing improper about them.

Senior prosecution official P.C. Srivastava said that from May 16 to 23, Rajesh Talwar had traveled to various places, including Haridwar. Ths Tuesday, the court will decide if Rajesh would be remanded into state custody or police custody, or released on bail

Dr. Dinesh Talwar warned that his brother was contemplating suicide.

The Hindu website said that on Tuesday, Arushi Talwar’s classmates and friends organized a peaceful candlight procession. They walked from DPS Noida to her house. That was a distance of 1 1/2 kilometers. The students said nobody close to Arushi was questioned by the police. The teens said that instead of investigations, the police were the laying the blame on the dead, who could not utter a single defence.

Arushi Talwar’s best friend Fiza said that police were defaming Arushi Talwar without owning evidence.

The media at The Telegraph wrote that Arushi Talwar’s maternal grandparents lived in Noida. Her parents re-settled in Noida to be near the maternal grandparents.

Arushi Talwar’s parents are highly educated, VIP connected, held high posts, networked with politicians and respected. Nothing can rock their boat. The media suggested that no matter what the circus showed, the end would be the same.

Pinaki Mishra, another Talwar family lawyer, has requested for the case to be handled by CBI (crime branch investigation?) because he was dissatisfied. Pinaki Mishra claimed Police made Rajesh Talwar a scapegoat.

Pinaki Mishra said that on Tuesday, May 27, 2008, when the case was brought to court, there was a lawyers’ strike that was on-going and the defence lawyers were banned from arguing their case. As a consequence, Rajesh Talwar has been handed over to the police for a 3 day custody period. Pinaki Mishra said he feared for the welfare of Rajesh Talwar.

Meanwhile, the brother, Dinesh Talwar, has appealed to the media to exert influence and pressure to press for an impartial hearing into the case against Rajesh Talwar.

Press Trust Of India reported:

Women and Child Development Minister Renuka Chowdhary today said that police who made statements on Arushi Talwar that did character assassination are liable to to be punished for defamation and insulting the modesty of a woman.

Minister Renuka Chowdhary said she would speak to Uttar Pradesh Chief Minister Mayawati and ask her to look into the matter once the Ministry get the details.

Police made some inconsistent statements.

- They made controversial declarations on who was the first victim in the twin murder.

- They said Hemraj was taken to the terrace before being stabbed. However, the trail of blood started on the stairs.

- They made a confession supposedly extracted from the accused.

- Their suspect claimed being framed and he did not confess to any murders.

- They had no proof on the status of the relationship between Hemraj and Arushi Talwar.

The finger prints on the cooler lid that covered Hemraj were not disclosed. The same went for the finger prints on the wall at the terrace.

The newspaper said that the police of Uttar Pradesh have leaked transcripts of Arushi Talwar’s communication with 3 boys. They refused to publish the transcripts because they cited that it was a invasion of privacy.

The press said that these actions came with the offered suggestions that the Arushi Talwar was loose. She asked her father to allow her to do something for one more time. It was hinted that the father and the friends were all loose.

PTI Dentist Rajesh Talwar, was sent to judicial custody till June 2, 2008. A court in Noida exercised this ruling after the expiry of his three-day police remand.

The Hindu reported that the police will not seek to extend Rajesh Talwar’s remand. He was handed over to the jail officers and has to complete 7 more days imprisonment. On Monday, June 2, the police might apply for court permission to administer narco tests, and brain mapping tests on Rajesh Talwar because he did not cooperate during routine police interrogations.

Police have not found the murder weapon or blood stained clothes.

Poliec pointed to an email in Arushi Talwar’s Orkut email account. They said it showed evidence that the relationship between Arushi Talwar and Rajesh Talwar was strained. Arushi Talwar had asked permission from her father to do something one last time. The date was Sunday, April 8th, 2007. Dr. Nupur Talwar explained that the email was not the cause of strain between Arushi and her father. She said that the email was a trivial one about a movie outing.

NDTV reported that Central Bureau of Investigation (CBI) has opened a file on the twin murders and its officers have visited the Talwar house. They spent the whole of Sunday in the flat looking at the scenes of crime.

The team has 25 officers and its head is Joint Director, Arun Kumar. Arun Kumar had previously successfully investigated the Nithari killings and Rizwanur Rehman murder case.

CBI’s time with Rajesh Talwar has expire. The suspect has sat for a lie detector test but the investigators could not derive any progress with the case. They claim that Dr. Rajesh Talwar has refused to answer questions, evaded questions and they had no hard evidence to pin blame on him. The authorities said that both Dr. Nupur and Dr. Rajesh gave conflicting statements and they could not confirm any fixed hypothesis.

The CBI said when they questioned the couple on how they could sleep through the night when two people were murdered under the same roof. The couple replied that they had closed their bedroom door and turned on the air-conditioning. They said they were sure that Aarushi’s bedroom door was open by the time Rajesh woke up to check on her.

CBI relied heavily on forensic tests. The lie detector test was useless. Rajesh Talwar is truly innocent or had outsmarted the machine!

The deceased viscera test results will be passed to CBI. The blood stained blanket, clothes and other items have been recovered too late. CBI could not confirm if they had been washed. The famous palm print at the terrace has been discarded as almost useless because it was a gloved print!

CBI suspected KK Gautam of having information or other relations as his reason for visiting the Talwars after Arushi’s death was investigated.

The security supervisor for the residential neighborhood, Shyam Sunder, was questioned.

CBI has retrieved the Noida police report filed on the first Tuesday after the twin murders, on May 20, 2008. The report said Rajesh Talwar had agreed to recover the mureder weapon and missing cell phones of the victims.

CBI believed that Aarushi Talwar was killed first before Hemraj. This was established from viscera reports, post-mortem reports, finger/ palm prints found in Aarushi’s bedroom and prints found in the terrace. They conclude so because the prints in Aarushi’s room were clean from blood and the prints found on the terrace had blood on them. So after Aarushi was murdered, her blood stained the prints of the killer.

On May 14, the computers in the Talwar housed had traces of search engine activities. The search was for sedatives that left no toxins after administration.

On Thursday, May 5, CBI conducted a second lie detector test on Rajesh Talwar, because the first test was inconclusive. A fresh test of questions was used.

Rajesh Talwar’s lawyer, Pinaki Mishra, would be sending in an application for bail and free him by Friday, June 6.

CBI has started searching in the drains in the Jal Vayu Vihar colony. They would get the help of workers from the Noida municipalit. CBI claimed that in the second polygraph test, they obtained clues whch lead them to suspect that the murder weapon might be found in the drains. They intend to look for something that was discarded since May 15-16. if the drains had currents in moving water, the weapon could have been washed away.

Dr Rajesh Talwar is remanded for another 14 days in judicial custody since the CBI has said that they did not want to question him any farther. His lawyer will apply for bail on Sat.

All India Institute of Medical Sciences was consulted. They examined the medical reports of Aarushi Talwar. Some experts said that she was killed by the blow and incisions to her head. Her neck injury was inflicted the last of all. The wounds were deep and could not be caused by a surgical scapel as the thin instrument could only cut through skin one layer at a time. Since the victim had deep wounds, it looked like it was the work of a knife. If the neck was cut first, blood would have sprayed out and stained the rest of the bedroom.The Associate professor of forensic medicine, Dr Sudhir Gupta, gave his expert opinion.

CBI could not find anything that would serve as evidence in the drains within the neighborhood of the Talwar house. The results of the lie detector test were unknown to the media.

Rajesh Talwar is currently in the Dasna jail in Ghaziabad district.

There was no application submitted for bail because the magistrate handling CBI cases was visiting the jail on Saturday. The case would be heard on Tues.

ibnlive has exclusive rights to the results of the polygraph test administered to Dr Rajesh Talwar earlier this week. Although the CBI said that the results were inconclusive, the readings on heartbeat and blood pressure showed that Talwar was under stress when faced with certain questions. CBI wished to conclude that there is no evidence against Rajesh Talwar.

Maybe its time for CBI to locate Vishnu, the former domestic help. Has he a reason to go missing?

The Talwars had a former male domestic helper who died a tragic death. His name was Nim Raj Kaushal alias Raju. There were very few writings about the death of Nim Raj Kaushal alias Raju. He died on April 15 2008. He was a domestic helper who filled in for Hemraj while Hemraj was away on holiday in Nepal. Nim Raj Kaushal alias Raju’s body was found by the road in east Delhi. Police insisted that he died as a result of his own negligent driving. His motor bike was found at the side of the road and so was his body.

Someone said that he stopped to buy a packet of cigarettes and was hit by a vehicle. Police said otherwise. The pack was found on his person, not in his hand, so he could not have immediately bought the cigarette and was hit by a vehicle.

The authorities would like to make it clear that Nim Raj Kaushal alias Raju died as a result of his own reckless driving. There was no mention of any eye witness. The case was not thoroughly investigated.

No one came to claim his body or motor cycle. His relatives were not around and not aware of his death.

When two gruesome murders have happened inside a house, the other occupants have no qualms to continue living in the same quarters. The survivors were very brave or there could be something in the house that needed people to stay there and protect it. It would be fair to argue that a vacant house could attract squatters, or it was too inconvenient to relocate, or the house held too much sentimental value to abandon by shifting away. Would there be any other liberal country that permitted free access to a scene of crime?

CBI suspected that the real killer or culprits were still living in the vicinity of the same block of flats. That was the reason for the curfew and restriction imposed on the residents of the same row of flats as the Talwar house. CBI did not say if they had used manpower to keep a close 24/7 watch on the flats.

Someone had access to the Talwar flat. Aarushi Talwar was locked inside her room every night, for her own safety. Dr. Rajesh Talwar kept the key under his pillow. He loved Aarushi and wanted to protect her by this act of paternal care.

On the night of the murder and the morning after the murder, Aarushi’s door was opened. Dr. Rajesh Talwar was surely unaware of that. What happened? It was on the morning of Friday, May 16, (or around that time) that the key was discovered not under the pillow but placed on top of a painting. How can a key be placed on top of a painting? The writer who wrote those words could have meant that the key was hung on top of a painting, or the painting was in a horizontal position and the key was placed on top of it.

Somehow, the key was stolen from under the pillow. The key was used to open Aarushi Talwar’s bedroom door and she was bludgeoned to death. Surely Rajesh Talwar was unaware the key was missing from under his pillow. He may have forgotten to check for the key before he put his head down on the pillow to sleep on that fateful night. Some might think that the issue with the key was a red herring to throw suspicion off the man who had access to the key.

There was a culprit who walked around the flat, removed the key, killed Aarushi and s/he maybe the same murderer who killed Hemraj.

This same culprit was always around the flat and that was why Aarushi had to be locked into her room at night. This person was probably a violent person who exhibited the rage in the way both victims were hammered and stabbed to death and beyond death. The blows to the head probably killed the victims first but the killer/s had to ensure the deaths by cutting the throats of the victims.

A person administering care to another violent person might look up information for safe sedatives to use. A sedative can be used to calm or lull to sleep, depending the specific dosage and chemical constituents.

It was reported that Dr. Nupur or Rajesh had instructed Hemraj to accompany Aarushi in the house and not to leave her alone at home. Hemraj had a daily chore/errand to perform for the Talwars and that was to travel out to their clinic. On the day that Aarushi was home alone, Hemraj was instructed not to leave the house. Hemraj was told over the telephone that he was not needed to travel to the clinic because that would mean leaving Aarushi home alone.

Home alone herself or home alone with what else?

A minor news report stated that Hemraj’s body showed signs of struggle. He had a human bite on him. It could have been an animal bite since there were no cross examinations to confirm the evidence of the bite before his body was disposed. There were no reports on any Hindu or Islamic burial for Hemraj.

There was a source who mentioned that Hemraj’s mouth had hair inside. This was seen when Hemraj’s body was found. It was unclear if the police had examined this evidence of hair.

CBI suspects there is someone in that area. The Talwars won’t shift from the flat inspite of it being the site of murders and a crime scene.

CBI said Krishna had worked as a compounder for the past few years and he knew the surgical procedures. His prints were also identified from the prints lifted from the Talwar house. CBI took Krishna to Hindon river, Khera village and Nithari. They suspected that the murder weapon may be recovered from one of these areas. CBI claimed that Krishna was the first person to tell them about the affair between Rajesh Talwar and Anita Durrani.

Krishna spoke to the media before he was taken away by the CBI. Krishna said he was being framed to protect Rajesh Talwar. His last words were a plea, “Save me!”

The CBI re-opened the hypothesis that Dr. Rajesh Talwar and Dr. Anita Durrani could have been involved in some improper relationship. They claimed that Krishna was the first to mention this.

The press hinted that Aarushi Talwar would be the next to face the character assassination.

For the record, there is no solid proof that the deceased girl had any sexual relations with any boy or man. The messages from her cell phone or internet social networking sites did not offer explicit proof of any great improper relationships between the girl or anyone.

There were a few cheeky commentators who tried to sneak in a few suggestions about having videos but these people came from opposites ends of the world that were far removed from Noida. (UK and Kathmandu) How probable is it that they could possibly own videos on a girl they had never met? If any one has evidence, do the right thing on the conscience.

Our readers and commentators are responsible and intelligent people. They will shoot down any fraudalent claims on videos.

CBI is trying to gather as much allegations on Krishna as possible. There is no real evidence yet.

Vishnu Thapa, one of the oldest ex domestic helpers in the Talwar household, had introduced Hemraj (Yam Prasad Banjade alias Hemraj) to work in the Talwar house. When Hemraj went for his vacation in Nepal, he introduced his cousin, Raju (Nim Raj Kaushal alias Raju) to take his place. In April 2008, Hemraj said Raju died in an accident. CBI has found Raju alive.

After Krishna’s relatives had protested about CBI’s informal detention of Krishna, the CBI has formally arrested him. The Nepalese relatives insisted that Krishna was in his bedroom sleeping with his nephew on the night that the double murders took place. The Nepalese cried foul and some other Nepalese in the region started a protest to show their displeasure. They allege that CBI asked Krishna to sign on blank paper and he did not know that he was going to go through the narco test.

The man who died at an accident by the road side had been mistaken to be Raju. A few websites had written this. His name was Minraj Kaushal. His name contained a “Raj” and he was mistaken to be the Raju who had worked for the Talwars.

Krishna’s phone made an outgoing call at 12.17.32 pm on May 14 to a landline number: 011-24360509. CBI officers confirmed that the number belonged to them but refused to acknowledge that they received a call from Krishna. When the newspaper, Express India, tried to call this CBI number, it had an engaged tone.

The newspaper learnt that Krishna has not been questioned on why he tried to reach CBI on the eve of the murders. CBI had asked Krishna to be their witness for their prosecution team. However, they have also arrested him. Krishna’s lawyer, F C Sharma, said that his family would file an application for bail in the CBI court in Ghaziabad this coming Monday, June 16.

TV reports are more cautious now. They hint rather than forthrightly declare they know information. They had been accused of miscommunicating and now exercise some caution. They offer some gossip since the timesofindia has also refused to confirm what actually went down. They offer what was desired to be communicated to the public.

The Talwar house has been raided by CBI again. A team from the All India Institute of Medical Sciences (AIIMS) might have been there. The officers opened all water tanks and pipes to check for the murder weapon.

A foreign object like a used weapon contains germs. A doctor who is well versed in sanitation and the physical hygiene of the water to the apartment would never hide a weapon in the water catchment area. Rust is poisonous and if the water is contaminated, the persons using it may fall ill.

On Friday night, June 13, 2008, The Durrani residence was raided to search for suspicious material.

CBI’s next focus was on the murder weapon. CBI claimed they have the facts on the origin of the weapon, and how it got into the Talwar house.

Rajkumar was attracted to Aarushi and he entered her room to sexually assault her. Aarushi resisted and he killed her. Rajkumar, Shambu & Krishna brought Hemraj to the terrace and killed him. The Talwars are innocent and had no role in the murders.

No information was given on the identity of Shambu. Rajkumar is Dr. Durrani’s man servant.

The Durranis were questioned by CBI. Their domestic helper, Raj Kumar was also interviewed. The Dr.s Talwar’s other part time domestic maid, Bharti, was questioned about the events on May 16, the day Aarushi’s murder was discovered.

CBI maintains that Krishna provided a khukri (Nepalese traditional machete) to Hemraj. Then, the khukri was handled by Rajkumar to kill Arushi.

CBI searched around Talwar’s house and Krisha’s room and removed 3 bags of material.

CBI said that they examined video footage and other expert accounts on Krishna’s clothing on the first day of the discovery of the murders. CBI claimed that Krishna changed his clothes and demanded his first set of clothes that he wore before the switchover. CBI claimed that his first suit of clothes may contain evidence like bloodstains. Krishna’s clothes have gone missing. CBI used 3 lie detector tests on Krishna. He was asked repeatedly about his missing clothes.

Vijay Mandal, a domestic helper from same L block in Jalvayu Viha, was interviewed by CBI. Vijay Mandal had to sit for the lie detector test.

CBI has been very hardworking. On Wed. night, they took Rajkumar to an undisclosed location and recovered something. They returned at 3:30 am.

Eight police officers from Sector 20 Police Station, who did the case for the Noida double murders of Arushi Talwar and Hemraj, were called to CBI headquarters at CGO Complex on Lodhi Road and questioned. They may be charged with the offence of destroying evidence. They were asked about the clothes Krsihna was wearing on the day of May 15, when Aarushi Talwar’s body was discovered.

CBI has cross examined the witnesses to match the statements given by all the suspects and police.

CBI said that Noida Police have clarified that they think Rajesh Talwar was at home on May 14. Nothing was said about the phone records that suggested Rajesh Talwar was not at home on May 14.

CBI has tried to reconstruct the scene on the night of May 14. They believe that with two noisy air-conditioners running, it was not possible to hear noises from the bedroom, with the door closed

Krishna’s khukri (machete) has been sent to a forensic laboratory for analysis.

In the psycho-analysis test, Krishna said he was in the neighbor’s flat, next to the Talwars’ flat, at the time of the murders.

In the narco-test, Krishna said he was in Talwars’ flat at the time of the murders. CBI faced these inconsistencies in statements.

37 days of investigations have passed. CBI took charge since May 31.

A prayer session was held at a temple at the Baba Balaknath Mandir in Sector-62 in the memory of Arushi. Dheeraj Kumar, the priest of the temple said that the prayers were for Aarushi Talwar’s soul.

When Krishna was led to appear before the judge for the CBI to request for an extended remand, he told the judge that the CBI officers did not allow him to sleep at night. Krishna claimed that he was being tortured regularly.

Dr. Nupur Talwar missed her scheduled second lie detector test at CBI offices because she was late. Nupur Talwar went to the prison center to visit her husband, Dr Rajesh Talwar and when she reached CBI office, the officers told her that it was too late. CBI would schedule another appointment for her to take the test.

Ekta Kapoor’s Balaji Telefilms went ahead to screen an episode in Kahani Ghar Ghar ki that was a parody of the Aarushi Talwar murder story.

I&B Minister Priya Ranjan Dasmunshi said that he will write to Eka Kapoor again to complain. Actually nobody had any legal right to stop the production or airing. Star TV denied that the episode used a screen plot on Noida’s double muder case.

Sahara Samay and ZeeNews reported basically the same things:

The CBI has rejected the request to release Dr Rajesh Talwar. They intend to keep him in remand until they can file a charge against him. There was a new application for bail but the newspapers have not written about the success/failure of this latest attempt yet.

Dr Nupur Talwar sat for her second lie detector test on Wed. June 25 but nothing more could be derived. The questions were concentrated on the nature of the relationship between Rajesh Talwar & Aarushi. Nupur Talwar’s answers decsribed their realtionship as being perfectly normal.

TimesNow reported: “Reports suggest Talwar’s lawyer was also assaulted by the agitating lawyers, even as Talwar’s defence counsel initiated the bail proceedings in the courtroom.”

That was the one essential and different sentence that merited attention in the entire report. The rest of it was nothing new.

NHRC sent their second letter to CBI to complain about their treatment of Krishna. CBI will reply soon.

Investigations are still ongoing. Nobody has been cleared from suspicion yet.

Rediff news:

Rediff wrote that Krishna confessed to killing Aarushi as she resisted Rajkumar’s sexual assault. Krishna’s motive was to wreck vengeance against Dr Rajesh Talwar for humiliating him in front of many patients when he made a mistake one day.

The murder weapon was conveniently explained away. He flushed it down the toilet. Hemraj objected to the murder of Aarushi so Rajkumar, Krishna & Shambu dragged him to the terrace and killed him there.

How trustworthy is Rediff News?

The unofficial media websites are working hard to do follow-ups on the trail of the Noida double murders. They have thrown up 2 major hypotheses:

1) Wife swapping and swingers club. Dr. Rajesh is a suspect. (from non-verified website called mid-day)

2) Krishna and Rajkumar have motives. Sources claimed that Krishna killed Aarushi. All the male servants; Krishna, Rajkumar & Shambu killed Hemraj because he threatened to report them to the Talwars. (from rediff news; another “shock jock” news site)

CBI counsel RK Saini opposed bail for Rajesh Talwar. CBI said both Rajesh & Nupur Talwar were not cleared from suspicion. CBI said both did not answer questions fully nor co-operate well.

Dr Nupur told a newspaper that she did not suspect any of the servants to be guilty of murder.

The facts are:

Rajesh Talwar was arrested May 23.

Krishna was arrested June 13.

Raj Kumar was arrested June 27. He will be remanded for 14 days. The nex hearing would be on July 11, where the status of his case will be heard before a magistrate.

Rajesh Talwar’s bail application was rejected. Dinesh Talwar said hat he did not go to work since May 16 because he had to look after his brother and his family. Dinesh said that Krishna had no motive to kill Aarushi. Whatever happened at work in Rajesh Talwar’s clinic was very minor and did not warrant murder. Nupur Talwar herself said in another interview that she did not believe that the servants could commit murder.

The security in Dasna Jail was tight. Nupur Talwar told a reporter that she was banned from sending home cooked food to her husband. Evidently, it was for his own security, which the person concerned did not seem to grasp.

On Friday, CBI took Krishna to the Talwar house and brought Rajkumar too. CBI questioned Nupur Talwar in front of Krishna & Rajkumar. No other specific information was given on this. The newspaper suggested that it was to reconstruct the scenario on May 15-16.

CBI arrested Rajkumar on Fri. June 27. A white T shirt was seized from his room in his employer’s house. Rajkumar had stayed with the Durranis, the couple who were dentists and friends/colleagues of the Talwars. The shirt was confisicated because it had blood stains. The white Tee was already washed. The first forensic test revealed that the stains were from human blood. It has already been examined at the Centre for DNA Fingerprinting and Diagnostics. It was sent to Hyderabad to test if the blood belonged to Aarushi and Hemraj.

CBI said that Raj Kumar has confessed. It was no specified exactly what he had confessed. CBI spoke on behalf of Raj Kumar, to claim that he would be able to recover Aarushi’s missing cell phone, his clothes and other things connected to the Noida twin murders. It was said that Rajkumar had broken the phone and hidden it somewhere.

Previously, CBI had also claimed that Krishna was able to recover evidence for them but nought has come out of these claims.

What did Raj Kumar say to all this? He said that he is innocent.

Until hard evidence is recovered, all claims are stories that are unaccompanied by solid proofs. The center of focus has transferred from Rajesh Talwar, to Krishna, and now Raj Kumar.

CBI has plans to subject Raj Kumar to a new narco analysis test and a P 300 wave test. The P 300 wave test is commonly called brain mapping or brain fingerprinting tests.

CBI said that the deleted pictures from Aarushi Talwar’s digital camera have been recovered. The photos show incriminating evidence of the people and clothes that were used. These images will be used to consolidate other proofs. The CBI has refused to elaborate further on the exact nature of the images recovered. They cite some confidential reasons for with-holding crucial details.

The CBI website’s last update said that Rajkumar would be remanded for 14 days, until July 11.

KK Gautam, the retired police officer, has been called to CBI offices at Lodhi Rd. CBI questioned him on his discovery of Hemraj’s body and specific details. KK Gautam & Noida Police claimed they found Hemraj first but the Dr.s Talwar claimed to the CBI that they saw Hemraj’s body first.

There was confusion about this since at the time Hemraj’s body was found, the Talwars were away at Haridwar to immerse the ashes of their daughter, Aarushi Talwar.

Either there was a mistake in the reporting by media, or the Talwars knew about Hemraj’s body before they left for Haridwar. When the Talwars returned, they then identified Hemraj’s body.

CBI deputy director Arun Kumar has been scheduled to return to his parent cadre. The case of the Noida twin murders may be shelved or continued. Since the senior CBI officer is leaving, all the investigations handled by him have an uncertain outcome; until a replacement or directive is found. The UP government denied that this recall had anything to do with the murder cases.

Krishna’s bail has been rejected. His lawyer, FC Sharma, protested but it was to no avail.

Special Judicial Magistrate (CBI) Sapna Mishra said if the charges lead to either life imprisonment/death penalty and they do not fall under certain provisions of CrPC 437, (age under 16 or medically unfit), the judge can’t grant bail to the accused.

It is Day 50 since the Noida twin murders took place in the wee hours of the morning on May 16.

India Today Group Online, ITGO, a small websit, published an article. None of the major newspapers have published this yet.

The bottle of Scotch recovered from the Talwar residence had blood and 5 sets of fingerprints.

It took so long for the CBI to discover the evidence because the bottle was wiped over. Officers used a ultraviolet light torch to shine over and examine the bottle and saw the faint impressions.

Forensic experts said the blood stains belonged to Aarushi Talwar and Hemraj. However, the CBI have not released any official statement regarding this latest find.

Zee TV claimed that Dr.s Rajesh Talwar & Nupur Talwar were out on the night of May 15, when Aarushi Talwar & Hemraj were murdered. The Talwars were alleged to be at a hotel where they had booked 12 rooms.

Well, Zee TV had better have the evidence to back up this claim or face serious repercussions. Let’s not hear about deletion of record in accounts. Some deleted records can be retrieved. Some can’t.

CBI has written a very short note to expose Zee TV claims. CBI said that Dr.s Rajesh Talwar & Nupur Talwar were at home on the night of May 15. The claim that a dozen hotel rooms were booked in Delhi is speculative and not true. CBI assures in their statement that they are diligent in their investigations.

A survey was done on many hotels in South Delhi. No hotel had block booking of more than 5 rooms on the night of May 15. No rooms were booked under the Talwar name for May 15.

CBI refuted Zee TV claims and said that none of their officers disclosed any information to Zee TV.

Satish Tamta, one of the senior lawyers representing the Talwars, has asked for the source who made claims on the booking allegation.

CBI has examined the results of the lie detector test given to Vijay Mandal. They discovered possible deceptions in the test. The test was administered on June 19. Vijay Mandal was still being questioned but he was not arrested.

Vijay Mandal is a driver in the Talwar neighborhood.

CBI thought that Vijay Mandal had lied about his presence in the Talwar house on the night of the murders. Vijay Mandal said he did not know Krishna and Rajkumar, although he was established as being good friends with them.

Vijay Mandal works for Puneet Rai Tandon, a resident of the same block as the Talwars in L-32, Jalvayu Vihar, Sector-25, Jalvayu Vihar.

Rajkumar is in CBI custody. Rajesh Talwar and Krishna are lodged in Dasna Jail.

Express India has interviewed Ram J Singh, one of the Jailors of Dasna Jail. He said that Rajesh Talwar spent his time reading non-fiction books, watching news and sat alone. His tears well up whenever the topic of Aarushi was mentioned. he was housed in Barack 7 of Dasna Jail, along with 150 other in-mates. His wife Nupur Talwar and his elder brother Dinesh Talwar visit him twice weekly. His lawyers visit him separately.

Krishna is lodged in Barack 5 as the CBI has requested that these 2 suspects be housed separately and banned from contacting each other. Krishna spent his time praying and writing Ram in his notebook. Krishna called upon Lord Ram, a deity in the Hindu religion, for help. Krishna’s brother visited him.

Rajkumar underwent his second narco test. Raj Kumar has taken narco-analysis, psycho-analysis, lie detector and brain-mapping tests.

CBI has started to investigate on Jeevan, a close relative of Hemraj. They are leaving no stone unturned.

This led to the arrest and interrogation of Vijay Mandal.

The murder weapon and Aarushi Talwar’s broken cell phone components were supposedly found.

The public were reassured that hardworking investigations will continue. Nothing was said about the possible transfer of CBI Director of Investigations, Arun Kumar, upon the expiry of his tenure. It was assumed that the case will be wrapped up and all loose ends tied soon.

49 days after his detention, Rajesh Talwar has been officially released from Dasna Jail. His lawyers have filed the papers to secure his release and he is expected to be out on Sat. July 12.

Neesha Barua and Rajeshwari; Aarushi’s classmates, affirmed their belief in the Talwars’ innocence.

The Talwars’ neighbour RK Tiwari, said he believed that Rajesh Talwar is innocent.

All newspapers carried the news that Dr. Rajesh Talwar has been released from Dasna Jail. His lawyers had completed the necessary paperwork and posted bail. A horde of media was present. Rajesh Talwar gave his wife a quiet hug. He promised to talk to the media later.

Across all media, like as if in unison, the articles have been focused on the mistakes of the police and CBI.

Without evidence, Rajesh Talwar was arrested. Now, without evidence, he was released. The media would like to focus their attention on Noida SSP Satish Ganesh, his senior, Gurdarshan Singh and Chief Minister Mayawati.

The reporter quoted Arun Kumar as saying that the first priority was to crack the case. After which, the investigation will be on negligent officers or those guilty of punishable crime.

The senior officers believed in the junior officers without checking. The junior officers believed in Krishna’s story without validating with proofs. Krishna had said that Aarushi confided in her classmate about her father’s involvement with Anita Durrani. Thus when Hemraj and Aarushi were found together, Talwar supposedly finished them off. No officers checked this story and the officers gave this to the media. That was how the chain of command evolved and the jumping to conclusions happened.

Three dentists have lost their jobs at Fortis Hospital in Noida. The person who gave the information could not be identified because he was not supposed to speak to the media. Dr. Rajesh Talwar, Dr. Nupur Talwar & Dr. Anita Durani were not invited to continue working there. The reason being they were visiting doctors and the hospital had no plans to bring them back. The hospital had decided this since May 16, the day the twin murders were discovered.

On Sunday July 13, some classmates of Aarushi Talwar went to visit her surviving parents at their flat. They expressed sorrow and regret at the tragedies after Aarushi’s death. They brought some flowers for the Talwars. Dr Mehra, who shared a clinic with Nupur Talwar near Khan market, also dropped in to visit.

The UP government will not punish the police regarding the Noida murder case.

On July 19, the Ghaziabad court extended remand of Vijay Mandal by 3 more days. He will be produced in court on July 22. Rastriya Jana Morcha (RJM) chairman Chitra Bahadur K.C. said that he will ask the Nepal government and National Human Rights Commission to save Krishna Thapa and Raj Kumar. Mulprabah Akhil Bharatiya Nepali Ekta Samaj, a New Delhi-based organisation of people of Nepalese origin, is taking up the issue with the government of Nepal and Nepalese Embassy in New Delhi. That would mean 4 different groups to assist in the case if they do get involved.

When there are no more places or persons left to search or interrogate, go back to the Noida Police. The CBI has asked the Noida Police for Krishna’s clothes.

Superintendent of Police R K Chaturvedi, denied the CBI’s claim that the attire was with them. When the Noida police were investigating the twin murders, Krishna was not named as a suspect yet and the police had no cause to keep his clothes.

Surat Singh, a lawyer based in Delhi, has filed a lawsuit to question the media reports that could have tarnished the reputations of the Talwars, especially Rajesh Talwar. The court asked the governments of Uttar Pradesh and Central government to implement a mechanism to restrain the media.

Here is an article on why it is not right to blame the media when in the beginning, the police was the first to heap allegations against the Talwars. The CBI has been guilty of detaining Rajesh Talwar for 50 days without admitting that it had no evidence to warrant a detention, until after his bailed release.

The minister for women and child development, Renuka Chowdhury, said she would be writing to UP chief minister Mayawati seeking the removal of Meerut zone inspector general (IG) Gurdarshan Singh. The article is here.

TOI reported that CBI was unlikely to meet the September 10 dateline to file a charge sheet against Krishna. That means he has to be released from prison. The 90 day custody period ends and Krishna is likely to get bail.

Vijay Mandal, Krishna and Raj Kumar were produced in the Ghaziabad Court on Thursday, Sept. 4. Inspite of protests from CBI, the court granted bail to Vijay Mandal. The judge said there was lack of evidence to press charges on Vijay Mandal. The bond on Mandal was set at Rs 25,000. CBI still claimed it awaits more reports from brain mapping and narco tests. The news did not state if Mandal or his sponsor had paid for his bond.

Vijay Mandal told reporters that CBI tried to convince him to become an approver against co-accused Krishna & Raj Kumar. Mandal declared he refused. He said the charges against Krishna & Rajkumar were false and framed them. Mandal’s brother, Shravan and another relative gave the sureties. Maandal spoke of his sufferings and his gratitude towards the media who believed in his innocence and his lawyer. He said he knew Krishna “a bit” and was not acquainted with Rajkumar at all. Mandal disputed the allegation that a murderer would take along strangers to help him commit murders. He alleged the CBI tried to trap him into saying wrong things when he was semi-conscious.

Vandana Talwar, Arushi’s aunt, said that the family was disappointed that the CBI failed to file a charge sheet against any of the servants. Vandana expressed her preference to see the accused behind bars. (source)

In other newspapers, the Talwars said they were disappointed that Arushi’s murderer was not caught. They supposedly said they would continue the investigation themselves should the authorities stop their work on the case. This sounded like they were reading the public’s reaction on the case.

On Tuesday, the special CBI court in Ghaziabad rejected the bail plea of Raj Kumar. CBI magistrate Sapna Mishra rejected the bail plea. One reason could be that CBI has until Sept. 10 to file the chargesheet and Tuesday was 1 day before the deadline. (source)

Minor triumph:

Krishna and Rajkumar were granted bail on two sureties of Rs 25000 each. The special court in Ghaziabad granted them bail. The court rejected several persuasions by the CBI who said –

1) Rajkumar & Hemraj had telephone records

2) Rajkumar & Krishna would flee to Nepal.

3) The two accused may destroy evidence

4) Probe against Rajkumar was underway and yielding results soon

The court rejected all the arguments from CBI.

The pathologist had been on unauthorized leave since Jan. 31. She reported for work on Mar. 26 – 29. Arushi’s murder happened in May 16. The pathologist was away and yet, reports have been signed in her name. What has happened? The original reports were missing from her cupboard. Or there were no authentic originals and the copies submitted to the CBI were fakes.

Rajkumar has been recalled from Nepal. Rajkumar arrived in Noida on Friday evening, Jan. 2. Rajkumar told Newsline that he had no idea about the reason. He had no written communication from CBI. Naresh Yadav, Rajkumar’s lawyer, wants to inform the court before handing over his client to CBI for interrogation.

Rajkumar has claimed on Dec. 26, 2008 that he has a hearing problem. He alleged he developed this problem after 2 narco-analysis tests conducted on him while he was detained by the CBI. Via Newsline.

Dr S Malini, the forensic lab assistant director, who had worked on the Talwar case, was dismissed. Dr Malini was the Narco analyst at the forensic science laboratory. She did the Narco tests analysis for the Talwar case.

Dr S Malini, assistant director of the forensic lab in Bangalore, was sacked. The Karnataka government fired Dr S Malini. Karnataka police claimed Dr Malini faked her age to get her job. Dr Malini was also accused of leaking information to the press. Malini had faced charges of tampering with evidence in the Abhaya murder case in Kerala. Malini had worked on high profile cases like the Malegaon blasts, the Hyderabad Mecca Masjid explosions and Arushi Talwar murder case and the Telgi case.

Disturbing and bad “news” have been released regarding the swab samples taken from the dead body of Aarushi Talwar. The rumors claimed the swabs removed from her virginal opening/ cervix were not from Aarushi. It is presumed the DNA on the swabs did not match Aarushi’s DNA so they have deduced the swabs did not belong to Aarushi.

The Centre for DNA Fingerprinting and Diagnostics in Hyderabad, received the slides in December 2008 and said the material did not belong to Arushi.

Otherwise the counterclaim is not valid. Now, the swabs are said to be from an unidentified woman.

The said swabs with fake evidence showed the absence of sexual activity.

There are accusations that the real swab samples may have been substituted after they showed results of sexual activity. Why else would the real swabs go missing and be substituted with an alternative?

The real swabs may contain the DNA and fluids of the assailant. Someone is protecting the suspect.

If Hemraj was responsible for any transgression, there would not be a large necessity to hide the truth. Both the dead may rest in peace. The living assailant needs masking, which may be why some people have taken elaborate efforts to fake evidence.

Dr Sunil Dohere, of Noida District Hospital, was the doctor who had drawn Arushi’s vaginal swabs. Dr Dohere (sometimes spelled as Dohre) claimed that there was some white discharge which suggested seminal fluid.

Dr Dohere’s senior, Dr S C Singhal, said no semen was found in slides prepared from the swabs. How tragic it is that Dr Singhal has since retired and isn’t involved in the case now.

The CBI sent one of the slides to Hyderabad. CBI allegedly did not investigate the two different claims by Dr Dohere and Dr Singhal, of the same hospital. Somehow, somewhere along the way, the slide or slides may have been swapped.

Arun Kumar, senior officer in Indian Police Service (IPS), has been sent back to Uttar Pradesh. Ashwini Kumar, CBI director, may have been responsible for this. The alleged reason was the tampering of evidence that was found. Ashwini Kumar did not investigate why the evidence was lost/ substituted/ destroyed. Ashwini Kumar also failed to register a case/ report about the discrepancies in the evidence.

Arushi Talwar’s cell phone, with her SIM number 9910520630, has been found. After 16 months, Ms Talwar’s mobile phome was located in the hands of a bank security guard named Ram Phool. Ram Phool works in Bulandshahr, Uttar Pradesh. Phool was arrested and questioned. After 16 months, Ms Talwar’s cell phone has been found.

Ram Phool’s sister found Ms Talwar’s cell phone in the vicinity of Dr Rajesh Talwar’s home in Noida. The sweeper lady gave the cell phone to her brother, Ram Phool. Phool has been using the phone intermittently. Phool only switched it on when he wanted to make a call and switched it off afterwards. That was how the source explained Phool avoided being traced by the cell phone signals.

New Delhi police recovered the cell phone and it has been handed over to the CBI.

Aarushi’s cell phone is a black colored Nokia N72. The CBI said they will not share their findings at this stage. Meanwhile, Mr and Mrs Talwar made some public statements about being hopeful that Aarushi’s cell phone yielding clues.

The Bulandshahr Superintendent of Police (City), J.K. Sahi, has been credited with saying a former domestic helper (or sweeper?) had given the handphone to someone in Uttar Pradesh.

Ram Bhule’s sister Kusum Bhule found the cell phone by the side of the road in Noida sector 40. Kusum kept the phone for several months in her possession, waiting for someone to claim it. When Kusum thought no one would ask her about finding a cell phone, she gave the phone away to her brother as a present.

Did she not read or hear about the Talwars’ residence murder case?

Anil, Ram Bhule’s nephew, denied that there was a SIM Card in the phone. Anil also denied the presence of videos and photos in the phone.

Some reports claimed Kusum found the phone in a park.

The slides were sent to the All India Institute of Medical Sciences (AIIMS) and kept for a month at the Department of Forensic Medicine. The chief of that Department, Dr TD Dogra, and Mr Talwar, are friends. Mr Talwar had worked as the senior eye surgeon at AIIMS. There is an unsupported,nagging accusation that Talwar may have influenced the subsequent actions involving the contamination/ switch of the slides.

Hemraj’s face was grievously mutilated and his corpse was abused to such an extent that he was identified using his clothes and bracelet (Kada).

Mr Talwar and Jeevan, Hemraj’s son-in-law, did not identify the body. Mr Talwar was said to have refused to identify Hemraj’s body. How odd.

Three persons acted as witnesses who identified Hemraj’s body. It was discovered that all three gave fake addresses. Needless to say, none can be located.

Nothing is clear cut in this case. May be, the body did not belong to Hemraj? After all, the victim was not properly identified. Even the witnesses have disappeared.

Jan 4 2010 – The Central Bureau of Investigation (CBI) has asked the Judicial Magistrate (CBI) Priti Singh in Ghaziabad to allow them to conduct narco analysis tests on Aarushi’s parents, Rajesh Talwar and Nupur Talwar.

Feb 11 2010 – Mr and Mrs Talwar will take the narco-analysis test on Thursday, Feb 11, at the Forensic Science Laboratory in Gandhinagar.

March 20 2010 – The social worker, Usha Thakur, was the only outside person Hemraj spoke to on May 11, 2008. CBI officers have interviewed Usha Thakur.

Nothing conclusive was deduced from the narco tests done on Mr and Mrs Talwar.

March 22, 2010 – “Arushi – The Love Story” movie.

Kamal Rasheed Khan (KRK) is going to make a biopic on Arushi Talwar. Khan said his film will solve the mystery of the murder of Ms Talwar.

Khan’s movie will be named “Arushi- The Love Story”. Khan claimed he has done research and knows who the killer is. Khan said he talked to Aarushi’s friends, neighbors, Noida police and the CBI. Khan claimed Aarushi’s friends tipped him on the girl’s multiple boyfriends.

The cast includes Kamal Rasheed Khan as the lead police investigator. Kabeer Bedi plays Dr Rajesh Talwar. Poonam Dhillon plays Nupur Talwar.

NCC cadets and an NGO planted saplings at a government college in Noida, on May 16, 2010. This commemorates the second death anniversary of Arushi Talwar.

The Talwar family, relatives and friends held a prayer ceremony at the Chinmaya Mission on Sunday, May 16. Dinesh Talwar said they established a society called “Aarushi’s Legacy”. This group works to help the less fortunate children.

May 19 2010: Arushi Talwar’s parents were asked to visit the CBI in Dehra Dun. The Talwars arrived in Dehra Dun on May 19 and they have been cooperating with the CBI.

Sources close to the CBI said they were aware that the crime scene has been disturbed intentionally to deceive investigations. One significant example was the disposal of the mattress stained with the victim’s blood. Other objects that were suspected to have been shifted were not mentioned. Investigations are being conducted to determine who were the people who visited the crime scene and may have displaced the items.

May 26 2010 -

The hand print lifted from the bottle of empty Scotch did not match the prints of any of the suspects. Someone from outside may have left the print on the Ballantine Scotch bottle. A bloody shoe print, size 8 or thereabouts, was left on the staircase. This shoe print failed to match with any of the suspects’ shoeprints. A blood stained finger print also was useless.

The CBI expressed doubts about the doctors taking swabs from Aarushi’s body. The vaginal swabs that were labeled allegedly from Aarushi tested negative and were determined not to be from the girl. Either the swabs were swapped or the swabs were from another source.

Richa Saxena, the pathologist doctor, was fired from her job in Noida not because of the irregularities in the vaginal swabs but because she was absent from her job for too long. Saxena had not reported for work since Jan 2008. Saxena was transferred to Fatehpur but she appealed against the transfer and didn’t report for work.

Richa Saxena, a friend of Rajesh Talwar, was accused of tampering with the vaginal swabs to hide the truth. Dr Nupur Talwar was familiar with Saxena as she used to treat her daughter.

Saxena denied the rumors and said she was being blamed in a bigger conspiracy. Saxena said she had collected the swabs from Dr Sunil Dohre during the post mortem he performed. The slides containing the swabs were handed over to two constables who then passed them to two technicians from the pathology lab of the hospital in Sector-39 of Noida.

Saxena, who had been on leave, suddenly showed up for work just so she could check the swabs.

One of the pathology lab technicians initially denied receiving the swabs from the police constables. Only after pressing interviews did he finally admit he had them.

There seems to be conspiracy and controversy at every step of the investigation. Nothing went right in the tedious trace of the evidence.

June 2 2010 – The CBI has interviewed Jeevan Pant Sharma, Hemraj’s brother-in-law, to get more information on Hemraj. The authorities are looking for Vishnu, the man who introduced Hemraj to the Talwars. They think Vishnu may know some information that could be helpful in the case.

The CBI are considering to conduct interviews and maybe narco tests on the doctors and lab technicians who handled Aarushi’s swabs. The investigators want to know the truth behind the issue. Who was responsible for swapping the real swabs for some fakes from another woman.

There was no concrete evidence to suspect any one of the three domestic helps working for the Talwar family.

June 6 2010 – Sources floated the hypothesis that facts were intentionally “prevaricated” to the advantage of Dr.s Talwar. The motive was to protect them. The CBI wants to interview the police officers in Noida who handled Aarushi Talwar’s case. The fog covers every step of the investigation. Facts are unclear and indistinguishable.

July 5 2010 -

DNA can be extracted from an object that a suspect has touched. This method is called the Touch DNA. The CBI is going to send samples of evidence to a lab outside India, to perform the Touch DNA and get identification of the DNA. This may save some DNA evidence even as the initial tests showed that the materials were tampered or contaminated. It is hoped that the sensitive Touch DNA method would be able to get some positive DNA for identification.

July 20 2010 – Gag order?

Dr Rajesh Talwar wants the court to gag the media. Dr Talwar thought the media was influencing the investigation and disrespecting the reputations of the persons involved.

Dec 29 2010 – The CBI surrenders in the investigation of the death of Arushi Talwar. The fake forensic evidence was cited as one of the factors that made a roadblock for the probe. The change in custody of the investigation was blamed on a direction taken to protect vested interests. . Lack of evidence made investigators face the wall. The CBI has filed a report asking the court in Ghaziabad to close the case.

Dec 31 2010 – After getting their brains soaked in narco analysis drugs and failing to provide definitive answers, the Drs Talwar said they were shocked at CBI’s closure of the case. Apparently, brain-mapping and lie detector attempts drew up zilch. In another show of protest, the Drs Talwar said they are going to stage an intervention to appeal against the closure of the case.

Veerappa Moily met CBI director Amar Pratap Singh to ask him to investigate the case seriously. The important face to face meeting lasted all of 10 minutes.

Dec 31 2010 -

Meira Kumar, PTI Lok Sabha Speaker, voiced her concern over the latest developments the murder probe has taken.

The blame game starts. CBI report allegedly named Rajesh Talwar as the sole suspect. Desperate to redeem its shattered reputation, the laughing stock of the country is terrified of reprisals if a charge sheet is levied against some lame duck who is accused. The first excuses, of having one too many cooks spoiling the broth of investigations by breaking the custody of command, have been rejected by a Speaker and a Minister. Scrambling to back pedal, contradictory statements have been leaked to various media. CBI hints it is bound and gagged. All parties concerned are playing ball.

Jan 1 2011 – Dr Rajesh Talwar was very angry and emotional during an interview with an NDTV reporter. He said he had opened his life to the CBI investigators. He had co-operated by submitting himself to several narco analysis and brain mapping tests. Dr Talwar challenged the CBI to produce evidence to substantiate their allegations. He was slightly incoherent at certain points, stumbling over his words, showing his emotional state.

Dr Nulpur started crying during the later stage of the interview. The couple showed solidarity and support for each other as they held each other’s arms, gripped the shoulder, massaged the fore arm, and showed signs of moral support for the spouse.

Dr Nupur refused to place the time when her husband and herself stopped surfing the internet. With an adroit move, she said she wasn’t sure of the time they switched off the internet. Dr Rajesh interrupted her by admitting he remembered it was 11:30 as someone called his cell phone at that time so he remembered the exact time he went off line.

Throwing punches left and right, Dr Nupur has voiced out against CBI, the media and all with platforms to voice their opinions. She warned against forming allegations without substantiated proof.

Rape cover up claims
1) Crime scene tampered with.
2) Touch DNA at crime scene unreliable.
3) Evidence not removed and kept properly by Noida police. Arushi’s clothes, mattress, etc. No chance of getting DNA samples from stains.
4) Vagina swabs claimed to be swapped to discredit samples.

Talwars are vapplying to obtain a copy of CBI’s report on the murder investigation.

The Law Ministry clarifies it is not interfering in CBI’s handling of the Talwar’s case. The Law Ministry plays protocol and backtracks, giving face to the investigative agency, saying it merely suggested the crime busters take a fresh look at their closure report. (After uproars from the Talwars and the public)

The Hindustan Times:
CBI’s report said retired deputy superintendent of police, KK Gautam, was asked by Dr Sushil Chaudhary, to accompany him to visit Dr Talwar’s home, on May 17, 2008. Dr Chaudhary is the owner of a private hospital in Noida.

CBI said Dr Dinesh Talwar (Aarushi’s uncle and Rajesh Talwar’s brother) was present at the Talwar home. Dr Dinesh asked Gautam to open the door leading to the terrace.
Dr Chaudhary told Gautam about Dr Dinesh requesting that rape should not be mentioned in the post mortem report on Aarushi.

Mr Gautam has denied the claims written by CBI. Gautam said nobody suggested he should open the lock leading to the terrace, thereby protecting Dr Dinesh Talwar. Gautaum protected Dr Chaudhary by saying there was no request to avoid writing about rape. Gautam said Chaudhary requested for a speedy report to be completed.

It seems that the press has read and printed some versions of what they guessed has happened. Someone orchestrated the discovery of Banjade’s body. Someone covered up Arushi’s rape. Dr Dinesh and Dr Chaudhary know some thing. There could have been a rape. The man servant was killed consequentially in some sort of relation to the event.

Jan 7 2011 -

Newspapers said anonymous sources in the CBI told them about a few clues which failed to produce more leads. Hemraj’s phone was active in the state of Punjab on the day after the crime. Later, the phone was used in sector 25 of Noida. Two fingerprints stained with the blood of Aarushi and Hemraj were found on the bottle of Ballantine Scotch. CBI could not identify the finger prints.

The Ghaziabad special court said that since CBI could not file a charge sheet against Rajesh Talwar, he should be given a copy of the investigative agency’s report. It is for the purpose of his application to protest against the closure of the murder case.

Ghaziabad special court allowed the CBI to close the case. The court did not agree with Mr Talwar that the case should be re-investigated.
